Financial Orders
On divorce or dissolution, the court has wide powers to divide assets, property, pensions, and income. We help you achieve a fair and lasting financial settlement.
Key Considerations
- The court considers all assets — property, savings, pensions, business interests, and income
- There is no automatic 50/50 split — the court applies a fairness test based on individual circumstances
- A clean break order prevents either party from making future financial claims
- Pension sharing or attachment orders can be made to divide pension assets
- Maintenance (periodical payments) may be ordered for a spouse or children
What to Expect
Financial Disclosure
Both parties must provide full and frank disclosure of all assets and income via Form E.
Negotiation
Solicitors negotiate on your behalf to reach a fair settlement, often without a court hearing.
Consent Order
An agreed settlement is recorded in a consent order, approved by the court to make it legally binding.
Contested Hearing
If agreement cannot be reached, a financial remedy hearing is held and a judge makes the order.
