Divorce & Separation
Ending a marriage is one of the most significant decisions you will make. Our family law solicitors provide clear, compassionate guidance through every stage of the process.
Key Considerations
- You can apply for divorce after 1 year of marriage under the no-fault divorce rules
- No-fault divorce means neither party needs to prove blame or wrongdoing
- A conditional order (formerly decree nisi) is followed by a final order (formerly decree absolute)
- Financial matters and child arrangements are dealt with separately from the divorce itself
- Legal separation is an alternative if you do not wish to divorce for religious or financial reasons
What to Expect
Initial Application
One or both spouses apply online to the court. A court fee of £593 applies.
Conditional Order
After a 20-week reflection period, you apply for a conditional order confirming the marriage has broken down.
Final Order
Six weeks after the conditional order, you can apply for the final order, legally ending the marriage.
Financial Settlement
A clean break consent order or financial remedy order should be obtained to finalise financial matters.
